Property Purchase Above Agreement Value: Stamp Duty Difference, Tax Risk and ITR Records

When the stamp-duty value rises between agreement and registration

A homebuyer may agree to purchase a property at one price, pay an advance and complete registration later, only to find that the stamp-duty valuation has increased by the time the sale deed is registered. That difference can create an alarming question: will the buyer be taxed as though they received a benefit equal to the higher stamp-duty value? A reported Kolkata ITAT decision involved a property bought for ₹1.23 crore where the stamp-duty value later rose to ₹1.46 crore, and the buyer received tax relief of ₹11.35 lakh. The practical takeaway is that the dates, payment evidence and legal conditions can matter; a valuation gap should not be treated as an automatic tax result without examining the transaction.

This is a property-purchase compliance issue, not a blanket exemption for every buyer. Tax treatment depends on the law applicable to the transaction and the evidence available. Buyers should preserve the agreement, payment trail and registration documents at the time of purchase, because reconstructing them after an income tax query can be difficult.

Understand the buyer-side rule before calculating any difference

Under the buyer-side rules for receipt of immovable property for inadequate consideration, a difference between the stated consideration and stamp-duty value can potentially be taxable as income from other sources if the statutory threshold and conditions are met. The law includes a tolerance mechanism, and the applicable version of the provision must be checked for the transaction year. Do not calculate a presumed taxable amount merely by subtracting the agreement price from the registration-date value.

There can also be a rule relevant to the date of agreement where the agreement date and registration date differ. In qualifying cases, the stamp-duty value on the agreement date may be relevant if the prescribed conditions are satisfied, including the manner and timing of payment. The detail matters: a vague statement that an advance was paid earlier is not the same as documentary proof that the statutory conditions were met.

Why contemporaneous payment evidence matters

Suppose a buyer signs an agreement when the stamp-duty value is close to the negotiated price, pays a booking amount by banking channel, and registers the deed several months later after local values have risen. The buyer should preserve the signed agreement, bank transfer proof, payment receipt and the valuation information relevant to both dates. Those records help establish that the price and transaction were settled earlier and allow the tax position to be tested against the applicable conditions.

Cash payments, undated receipts or an agreement created after the dispute began can weaken the evidentiary record. Keep evidence of each instalment, including UPI or bank references, lender disbursement records and the builder or seller's ledger. If payment was made by a relative or lender, keep documents explaining the source and the relationship to the transaction. A home loan sanction alone does not prove that the buyer paid the agreed consideration on the date claimed.

Do not confuse buyer taxation with the seller's capital-gains computation

The buyer-side question is separate from the seller's possible application of stamp-duty valuation rules when computing capital gains. One transaction can therefore require two different analyses. A buyer should not assume that a seller's valuation dispute automatically determines the buyer's tax position, and a seller's capital-gains computation should not be copied into the buyer's return.

If the buyer later sells the property, the later sale may create capital gains and require a separate computation using acquisition cost, improvement records, transfer expenses and the rules applicable in the year of sale. A purchase price difference that caused concern at registration does not by itself establish the later capital-gains figure. Keep the registered deed and evidence of eligible acquisition-related costs for future use.

How to review the ITAT report without overgeneralising it

The reported decision describes a purchaser who obtained relief where the stamp-duty value rose between the agreement and registration dates. A headline is not a substitute for reading the order and comparing its facts with your own. Before relying on a decision, identify the exact provision, the relevant assessment year, the payment method and dates, the valuation considered by the authorities, and the reason the tribunal granted relief. A result based on one buyer's documents does not establish that every later registration-date increase is ignored.

Keep a copy of the order and take advice if the same issue is raised in your case. The evidence should show what happened, when it happened and how the payment conditions were satisfied. Where the transaction documents are incomplete, or the difference is substantial, obtain a written analysis before taking a return position.

Preparing the return and responding to a tax query

A property purchase does not always require a separate income-tax return entry, but a notice, AIS information, high-value transaction reporting or a mismatch in the taxpayer's financial profile may require an explanation. If the department asks about the source of funds or the valuation difference, respond to the question actually asked. Provide a concise chronology, agreement and registration dates, payment schedule and documentary evidence. Avoid sending an unindexed bundle of papers without explaining which document supports which fact.

If the purchase creates taxable income under the applicable buyer-side provision, the amount and reporting category should be checked with a tax professional. A homebuyer who also has salary, interest or other income must still select the correct return form based on the whole year's circumstances. ITR-1 can be used only when its eligibility conditions are satisfied. Capital gains, multiple properties, foreign disclosures or other excluded circumstances may require ITR-2; business or professional income may call for ITR-3 or eligible ITR-4.

AY 2026-27 filing dates and record preparation

For FY 2025-26, the last date without late fee for non-audit ITR-1 and ITR-2 cases is 31 July 2026 unless officially extended. For applicable non-audit ITR-3 and ITR-4 cases, the due date is 31 August 2026 unless officially extended. The Income Tax Department may extend deadlines, so verify the latest official announcement rather than relying on an old calendar. Filing late can lead to a late-filing fee and may affect the ability to carry forward certain losses under the applicable rules.

For a property transaction, organise the documents well before filing. Compare AIS and TIS with the information in your records, and review Form 26AS for any tax-credit entries relevant to the year. If the return does not require reporting the purchase itself, the underlying records still matter if a later query asks how the transaction was funded or why the agreement price differed from the stamp-duty value.

Homebuyer checklist: protect the position before a dispute

  • Keep the signed agreement, amendments, allotment letter and registered conveyance deed.
  • Preserve bank statements, UPI references, receipts and lender disbursement evidence for every payment.
  • Record the agreement date, registration date and stamp-duty values applicable on each date.
  • Check whether the statutory agreement-date rule and payment conditions apply to the facts.
  • Separate buyer-side tax analysis from the seller's capital-gains treatment.
  • Reconcile reported information and seek advice before replying to a tax notice.

The reported relief illustrates why a valuation increase between agreement and registration needs a fact-specific review. It does not remove the need to comply with the statutory conditions. A clear payment trail and properly preserved documents are often the difference between a supportable explanation and a difficult notice response.
